Cancellation & Refund Policy

1. Overview & Scope
This policy applies to all services offered by Bizztimes (a registered partnership firm, GSTIN: 19AATFB0747L1ZW), including custom enterprise software development, IT consulting, SaaS product licenses, and managed services. By engaging Bizztimes through any signed agreement, the client agrees to these terms. This policy is governed by the laws of India and subject to the jurisdiction of courts in Kolkata, West Bengal.
Note: Specific terms in your contract or SaaS subscription agreement take precedence where they differ from this policy.
2. Cancellation Policy
All cancellation requests must be submitted in writing to swaroop@bizztimes.com with your project reference or contract number. Verbal notice does not constitute a valid cancellation.

3. Refund Eligibility
A refund may be issued in the following circumstances:
- Bizztimes is unable to commence work within the agreed start date (more than 14 days delay solely attributable to Bizztimes) and the client elects to cancel.
- A critical deliverable is demonstrably undelivered after written escalation and a 7-day rectification window has elapsed.
- A duplicate payment is received for the same invoice — the excess is refunded in full.
- A project is cancelled before any substantive work has commenced and the advance paid exceeds the booking fee in the contract.
- A written mutual termination agreement specifies a refund amount.
Where work has commenced, refunds are calculated based on deliverables completed, resources allocated, and third-party costs incurred. GST already remitted to government authorities is non-refundable in any circumstance.
4. How to Raise a Request
- Email swaroop@bizztimes.com with subject: "Cancellation / Refund Request - [Your Company Name]"
- Include: project name, contract/PO reference, invoice number(s), amount paid, and reason for request.
- Bizztimes will acknowledge within 2 business days.
- A decision will be communicated within 10 business days of acknowledgement.
- Approved refunds are transferred to the original payment source within 7-15 business days.
5. Processing Timelines

A refund confirmation email with transaction reference will be sent upon processing.
6. Non-Refundable Circumstances
- Services already rendered and accepted by the client, including approved milestones.
- GST or any government levies collected and remitted on Bizztimes' behalf.
- Third-party costs incurred on behalf of the client — cloud infrastructure, domain registrations, API subscriptions, licensing fees, or any external service.
- Delays or non-delivery caused by the client (delayed feedback, missing credentials, scope changes, or failure to provide inputs on time).
- SaaS fees for the current billing cycle once it has commenced.
- Change of mind or business direction after project commencement, without a demonstrable failure on Bizztimes' part.
- Refund requests submitted more than 30 days after the event giving rise to the claim.
Bizztimes reserves the right to offset any refund amount against outstanding invoices or costs incurred on the client's behalf.
7. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation within 15 business days of written notice. If unresolved, the dispute shall be referred to a mutually agreed mediator. If mediation fails, disputes are subject to the exclusive jurisdiction of courts in Kolkata, West Bengal, India.
